Short Description: LOCAL GOV FOREIGN FIRE INS
Amends the Illinois Municipal Code. Provides that a fire
department foreign fire insurance board in a municipality with fewer than
500,000 (now, 250,000) inhabitants shall have 7 trustees, including the fire
chief and 6 members of the fire department (now, the Board is established by
ordinances of the corporate authorities). Provides for an annual election of
board officers. Provides that the annual municipal audit shall include funds
appropriated to the board and shall determine whether the funds have been
expended by the board only for the maintenance, use, and benefit of the
department. Amends the Fire Protection District Act. Provides that in each fire
protection district that has an organized fire department there shall be a
foreign fire insurance board. Provides that the board shall have 7 trustees,
including the fire chief and 6 members of the fire department. Provides that
officers shall be elected annually. Authorizes the board to make rules.
Provides that the treasurer must give a bond to the board. Provides that the
board shall develop and maintain a list of items that are appropriate
expenditures. Provides that the annual fire protection district audit shall
include funds appropriated to the board and shall determine whether the funds
have been expended by the board only for the maintenance, use, and benefit of
the department. Makes other changes. Amends the State Mandates Act to require
implementation without reimbursement. Effective immediately.

WHY DO WE OPPOSE
With the current economic issues, there are some Districts and Departments that
would be economically strapped if they have to create a Board who would use
those funds for non operational needs. This is a local government issue and
not one to be decided by state government.

Creates the First Responders' Mobile
Communications Transition Act. Requires that the Director of State Police
appoint a task force to develop and adopt a plan for the coordination of a
mobile communications infrastructure for the State's first responders. Requires
that each State agency, unit of local government, public institution of higher
education, community college district, and school district that is a first
responder or employs one or more first responders must coordinate its first
responders' mobile communications in compliance with the infrastructure plan by
January 1, 2019. Requires the Department of State Police, upon recommendation of
the task force, to make grants and loans to those entities to assist in their
compliance. Establishes reporting and auditing requirements. Preempts home rule.
Repeals the Act May 1, 2021. Amends the State Finance Act to create within the
State treasury the fund for the loans and grants. Effective immediately.

Amends the Property Tax Code. Provides
that, in Cook County, homestead property must be valued at 100% of its fair cash
value. Requires the Cook County Clerk to abate the property taxes levied on
homestead property in an amount equal to: (1) the amount of the aggregate
extension of all taxing districts against the property; less (2) an amount equal
to 1% of the equalized assessed value of the property. Sets forth procedures to
apply this abatement to the aggregate extensions of each taxing district.
Creates the Cook County general homestead exemption to limit the assessment
increases of homestead property to the lesser of: (i) 2%; or (ii) the increase
in the CPI. Sets forth the taxable years in which this general homestead
exemption applies. Amends the State aid provisions of the School Code to provide
that, if the general homestead exemption is determined under the Cook County
general homestead exemption provisions, then the available local resources are
not effected. In provisions concerning the Property Tax Extension Limitation Law
in the Property Tax Code, defines "extension limitation", for the 2009 taxable
year and thereafter, as (a) the lesser of 2% (now, 5%) or the percentage
increase in the Consumer Price Index during the 12-month calendar year preceding
the levy year or (b) the rate of increase approved by voters. Amends the State
Mandates Act to require implementation without reimbursement. Effective
immediately.

Act. Defines "catastrophic injury" as a grievous or serious injury or impairment
of a nature that is sufficient to permanently preclude the injured employee from
performing any gainful work. Provides that an employer may, at its expense,
require an employee seeking benefits under the Act to submit to examination by
up to 3 licensed physicians. Provides that the determination of whether an
employee has suffered a catastrophic injury shall be made by the employer's
corporate authorities or a person designated by ordinance, whose determination
shall be final and subject to judicial review under the Administrative Review
Law. Provides that the employer shall be deemed a necessary party to any case
brought under the Administrative Review Law.
